I own one suit -- just trousers and a jacket, no vest/waistcoat, and I think it cost me U$500. But of course that doesn't address my terrible emotional suffering, grief and loss if my dry cleaner were to lose my trousers. I have a very high-class, aristocratic kind of emotional suffering, grief and loss, and it's not cheap.

Panel Considers Reappointing Judge Roy L. Pearson Jr.

It began innocently enough. A dry cleaner losing a pair of pants, an enraged customer seeking justice ... just like that episode of Seinfeld. We've all been there, we've all wanted revenge, but what can we do? What indeed. Unfortunately for the Chungs, owners of Custom Cleaners in Northeast Washington, this pair of misplaced pants belonged to Judge Roy L. Pearson Jr., who unleashed an avalanche of legal absurdity so perverse Kafka would blush.

The administrative judge -- whose job, mind you, entails determining civil infractions and penalties -- claimed that he deserves $65,462,500 in damages for the "mental suffering, inconvenience and discomfort" caused by the loss of his suit pants. To put that figure in some perspective, at his current salary, it would take Judge Pearson just under 650 years to earn that kind of cash.

Despite his seemingly ridiculous claim, because of Washington's bizarre consumer protection laws, Pearson has been able to stretch his trouser-tort out for a couple years now, costing the Chungs many sleepless nights and thousands of dollars in legal fees. Their plight has been so vexing that they even offered him $12,000 to settle, and for the record his suit including the jacket, which wasn't lost, had a value of only $1,100. But still he refused. Now broke and "disenchanted," the Chungs are considering moving back to Seoul, their American dream throttled by American litigation.

Now if there was any justice, a person like Pearson would be disbarred for his actions, but as irony would have it a "panel of four D.C. officials" is currently assessing whether he will be reappointed to another 10-year term. That means Pearson could actually spend another decade on the bench, handing down decisions and determining justice. Talk about the fox guarding the hen house. The only thing crazier than keeping him on the bench would be appointing oil executives to run the Environmental Protection Agency ... oh wait.

Pearson is the product of a spoiled, have-anything-I-want childhood. He needs to get over himself and let this go. It's just a pair of pants! There are so many other injustices in this world to be outraged over and fight for other than a stupid pair of pants. It's not like it's the only pair he has either. Remember that what goes around, comes around; and he'll get this same treatment in return, plus some. He's already given himself a bad name and probably has ruined his career because of his narcissistic attitude.

It is a shame that in our society even judges will dishonor their positions. Society looks up to judges as moral barometers and no one expects to see the system and immigrants abused and bullied by one. I sincerely hope that this judge is disapplined in some form for his disgraceful, childish and entitled behavior.

Emil, How can we all find out the names of the four judges considering this guy's reappointment? I think some input from the public into this decision is in order. It would be a travesty to have this guy sit behind a gavel for another 10 years!

This guy is an a-hole. We should also note that his obstreperous actions raise the cost of dry cleaning for everyone in the DC area.

Worse, he's an idiot. He's a judge, but he shows a clear misunderstanding of basic contract law (no emotional distress except in extraordinary circumstances; no punitive damages; no unforeseeable reliance under Hadley v. Baxendale). Of course he might be trying to sue in tort, but this is a clear contract case and the case should be thrown back into the contract arena by the pure pecuniary loss rule

It's abuse and childish on the judges behalf. The Chungs made a mistake of misplacing his pants. BIG DEAL!! They made an honest mistake and suing for that amount is CRAZY!! At worst sue for the amount the pants cost. There has to be something that the Chungs can do about this crabbie judge. I wish them the best.

I think you're missing the point. That must have been a really nice pair of pants. You know, the kind that you could search for a lifetime and never find again.
Take a step back from all the legality and walk a mile in this man's shoes, except try to walk that mile without your favorite pair of slacks. If you take some time out and think about it, it's absolutely heartbreaking.

To make matters worse, he got screwed by a bunch of immigrants. There's no justice for situations like this. Everyone loses. Except the sweat shop workers who make the pants, probably somewhere in Korea. Because now they get to make one more pair of pants.

On Gene Weingarten's chat update one poster refers to the "a##hole tax", the penalty we all pay for the sins of a few, examples being self flush toilets, hot air hand dryers, etc. "Judge" Pearson [he is an administrative law judge, not a real judge, so I am sure he insists on being called "Judge"] is a more heinous example. Too fat to fit in his suit pants, too solipsistic to accept that things happen, too ego centric to comprehend the damage he does to public confidence in the system, he will create a counter movement that will work to the disadvantage of people with legitimate complaints.

OMIGOD! Another ratification of my addage, "Republicans Own The Best Judges Money Can Buy". I'm willing to bet he left the receipt ,from Pamela Martin Associates, in the pants and needs it for his negotiations for his book and movie. I say go ahead with discovery, bring the 'judge' in for a deposition and see if he really has suffered $65M worth of damages or only $6.50 that he paid for his britches. The Chungs should sue Pearson for public stupidity on a national scale. I'll be watching for his name on "20/20".

I would suggest this judges' actions are driven by something more than a simple desire to prove a point. His refusal to accept a settlement well beyond any just compensation demonstrates an attempt to destroy someone's livelihood using the burden of litigation.
I'm curious what his record on the bench looks like in cases involving persons of asian descent.

This guy is an american helping destroy the country that I have been raised in, fought for and support. Actions like this should be considered similar to terrorism, of course without the killing. If the justice system works he will be removed from position immediately, counter sued for damages and thrown in joe arpaios tent city in arizona (where you have none of the luxuries of prison) for a long time. Then when he gets out take his citizenship away, send him to korea and let the justice begin.

What is sad is that he is finding joy in the complete destruction of someone's life for an inconvenience that means nothing.

He is proof that some people are just bad people. They are just mean-spirited at heart and get joy from being cruel. I pity him more than anything. He's not even a man.

However, GOD IS JUST. He WILL be judged for this in the court that really matters and he'll lose that case for sure.

As someone who's been screwed over by Custom Cleaners too let me say there service sux. I'm glad they're going out of business. $65 mil is a lot of money but the sign said "Satisfaction Garaunteed" and Pearson wasn't satisfied. They needed to their fraud right and they failed. Now they have to pay for it. I'm sick of people doing a half assed job. Cleaners will be a lot more careful from now on you can bet.

Step one: The judge's claim must be denied and sanctions imposed on him. The rules of court provide for sanctions to be imposed on those who bring BS lawsuits. The amount of the santion ought be the same amount the people being sued had to pay for legal fees. Step two: The judge's job cannot be renewed. Step three: Serious disciple ought to be imposed by the the bar; maybe a suspension but not disbarment, that's too harsh.

TO TOM: According to the article he asked to be compensated for the suit and they refused. It was only after he brought them to court that they tried to settle. He was reasonable first and they thought he would buckle. He didn't and now they are crying about it. I got no sympathy for sham artists like them. Let them go back to Korea, no skin off my back.

A judge needs to know the law well, and have good friends in powerful positions. That's about all it takes. The guy could be an a**hole but hey, this is what happens when our society is results-driven. Ethics are out the door these days. What matters is if you can deliver solid results. This happens in every sector, not just law.

As Americans it our right to sue. No other country in the world allows it to level we have. Maybe the judge went to far, but he didn't break any law or violate any oath. I find it absolutely appalling that this man should continue to practice law and certainly hope that there is some justice in the fact that he be quickly revoked of any "power" he may have. To the gentlemen to who have this man's career in their hands, to keep him in power is to do an extreme diservice to your profession. That he feels he has been wronged is one thing. What a sad day when a judge in this country is doing this kind of thing. We put people in jail for running scams and taking advantage of people...in this situation we have him as a judge. I would be first to say that the Chung's should replace the pair of pants, shake hands and go on their way but to throw out a number of $65 million dollars is absolutly ridiculous. I have also read thru Pearson's divorce paperwork and my best wishes go out to his ex-wife, I hope that she is now able to get on with her life. I hope that the Chung's are able to get thru this with the help of people like us that have a heart or have lost a pair of pants at the cleaners at one point or another in our lives and have moved on! What a pathetic excuse of a human being!!

Is this the true american dream??? Make money off of people who works hard to pay for their kids to go to collge, so they can be a lawyer and maybe someday become a JUDGE??? They pay taxes so that U.S can hire/select judges so they can make the right decisions for the people??? WTF.... They even offered him atrocisou amount of $12,000 so he shuts and stop whining about his $45 pants... Hs is a MORON, I repeat he is a MORON!!! This judge should be removed from his chair and striped off of his title. He is not a judge that I want to make a righteous decisions for Hard working Americans, I do not think anyone wants that... This is probably the first time he ever sued for $65 milion dollars but if this was a real case in his court he would have thrown it out because THIS IS RIDICULOUS!!! What a waste of tax payers money and our judicial systems time!!! With this much time and money spenc on this case we could have convicted another murderers, rapists, gangbangers, white collar criminals etc. DC judicial system should convict him for an EXTORTION!!!

As someone who's been screwed over by Custom Cleaners too let me say there service sux. I'm glad they're going out of business. $65 mil is a lot of money but the sign said "Satisfaction Garaunteed" and Pearson wasn't satisfied. They needed to their fraud right and they failed. Now they have to pay for it. I'm sick of people doing a half assed job. Cleaners will be a lot more careful from now on you can bet.
